Terms of Use

Welcome to www.Eco-Locals.com (“Eco-Locals.com”).These Terms of Use, the Privacy Policy, the Mobile Devices Terms and all policies posted on our site set out the terms on which we offer you access to and use of our site, services, applications and tools (collectively “Services”). You can find an overview of our policies directly below this paragraph. All policies, the Mobile Devices Terms, and the Privacy Policy are incorporated into these Terms of Use. You agree to comply with all the above when accessing or using our Services.

 

Posting Policies

The following activities are prohibited from eco-locals.com Canada:

 

  • Posting an item for sale that is not located in Canada.
  • Posting an item for sale that is illegal to own, buy or sell in your area of residence.
  • Posting an item for sale that is in the prohibited items and services list.
  • Posting duplicate ads in multiple categories.
  • Posting ads using multiple different email addresses.
  • Posting an ad that serves no other purpose other than to send traffic to a web site.
  • Posting a multi-level marketing or other prohibited job.
  • Posting an ad containing a list of keywords not directly related to the item being sold.
  • Posting an ad that contains adult, mature or erotic content. Personals are not allowed.
  • Posting an ad that defames anyone or contains “hate speech”.
  • Posting opinions, notices, and discussion topics which should instead be posted on social media sites.
  • Posting an ad in an incorrect or misleading category or with misleading information.
  • Posting an ad that violates our Pet Posting Policies.
  • Posting as a Private Seller, Owner, or Individual when you are a Business, Dealer or Professional.

 

Please note:

  • Users must be at least 16 years old* to post ads on their own. Ads for our younger users must be posted by an adult for security reasons.
    • *We care about the safety of your entire family. We understand that in the age of technology, kids are on the internet more than ever and free online classifieds can be a fun way for them to find toys, video games, clothes, and other cool items.
      While we pride ourselves on being a site that the whole family can use, we also know the concerns involved with transacting online.

      We want to minimize these risks. Therefore, for anyone under 16 years of age, we ask that you have your parent/guardian respond to any ads you may be interested in. Also, if you wish to post an ad on eco-locals.com, have your parent/guardian do so on your behalf, so they can be directly involved in the transaction.

      eco-locals.com ltd. reserves the right to remove any ad if we feel it is in the best interest and for the safety of our users.
  • Any ads that do not comply with eco-locals.com policies may be removed from the site. Additionally, users who violate such policies may be blocked from using Kijiji in the future.
  • We may, at any time, remove an ad if we believe it interferes with the well-being of the community or the spirit of eco-locals.com.

Our general rule is that you may not list, buy or sell items or services that are illegal to own, buy or sell in your province of residence, or that are not bought or sold in compliance with applicable laws and regulations. You are responsible for ensuring compliance with all applicable laws relating to the item you list, buy or sell.

Your Account. In order to access and use some or a portion of the Services, you may be required to register with us and set up an account with your email address and a password (your “Account”). The email address you provide will be your email address, and you are solely responsible for maintaining the confidentiality of your password. You are solely responsible for all activities that occur under your Account. Therefore, you should protect your password and make your password difficult for others to guess.

You may connect to the Services with a third-party service and you give us permission to access, store, and use your information from that service as permitted by that service and as may be described in our Privacy Policy. If you believe your Account may have been compromised or misused, contact us immediately at Eco-Locals Customer Support.

Using Eco-Locals Services. You will post in the appropriate category or area and will not do any of the following actions:

  • violate any laws or our Prohibited Content Policy;
  • be false or misleading;
  • infringe any third-party right;
  • distribute or contain spam, chain letters, or pyramid schemes;
  • distribute viruses or any other technologies that may harm Eco-Locals or the interests or property of Eco-Locals users;
  • impose an unreasonable load on our infrastructure or interfere with the proper working of the Eco-Locals;
  • copy, modify, or distribute any other person’s content;
  • use any robot, spider, scraper or other automated means to access Eco-Locals and collect content for any purpose without our express written permission;
  • harvest or otherwise collect information about others, including email addresses, without their consent;
  • bypass measures used to prevent or restrict access to Eco-Locals.

Abusing Eco-Locals Services. Please use the flagging system to tell us about any problems or offensive content so that together we can keep the Services site working properly. We may limit or terminate our Services, remove hosted content and take technical and legal steps to keep users off Eco-Locals if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Eco-Locals or not, we do not accept any liability for monitoring Eco-Locals or for unauthorized or unlawful content on Eco-Locals or use of Eco-Locals by users.

 

Global Marketplace. Some of Eco-Locals’s features may display your ad on other sites that are part of the global community, like on our classifieds sites in other countries. By using Eco-Locals Services, you agree that your ads can be displayed on these other sites. The terms for our other sites are similar to these terms, but you may be subject to additional laws or other restrictions in the countries where your ad is posted. When you choose to post your ad to another site, you may be responsible for ensuring that it does not violate our other site policies. We may remove your ad if it is flagged on any of our sites, or if we believe it causes problems or violates any law or policy.

 

Fees and Services. Using Eco-Locals Services is generally free. We may charge fees for certain Services. If the service you use charges a fee, you will be able to review and accept that charge. Our fees are quoted in Canadian Dollars, and we may change them from time to time. We will notify you of changes to our fee policy by posting such changes on the site. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service. Our fees are non-refundable, and you are responsible for paying them when they’re due. If you don’t, we may limit your ability to use the Services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, you permit us to instruct PayPal to deduct the amount owed from your PayPal account balance).

Canadian taxes associated with our Services will be collected when applicable. You agree to provide accurate address information necessary for Eco-Locals to comply with its obligations under applicable law. To the extent that such information is not provided, Eco-Locals will in its discretion determine and collect appropriate taxes.

You are solely responsible to collect and remit any applicable taxes resulting from the sale of your items or services listed on Eco-Locals.

Content. Eco-Locals Services contains stuff from us, you, and other users. You agree not to copy, modify, or distribute Eco-Locals Services, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. If you believe that your rights have been violated, please notify Eco-Locals Customer Support and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or the rights of any other party.

 

Reporting Intellectual Property Infringements (Verified Rights Owners – VeRO). Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale). We reserve the right to remove content where we have grounds for suspecting the violation of these terms, our policies or of any party’s rights. The following steps are for reporting a listing to Eco-Locals that you believe to be infringing on your intellectual property rights. Only the intellectual property rights owner can report of potentially infringing items or listings through Eco-Locals’s VeRO Program. If you have a good faith belief that a listing on any of the Eco-Locals Services infringes your copyright, trademark, or other intellectual property rights, all you need to do is download our Notice of Claimed Infringement (NOCI) form, fill it out, and fax it to Eco-Locals. After we receive your first NOCI, Eco-Locals will confirm your enrolment in our program and send you the instructions on how to submit future reports electronically. We reserve the right to share, in accordance with applicable law, the completed NOCI form with the third party that originally posted the potentially infringing listing.

 

Disclaimers and Limitations of Liability. The Eco-Locals Services are provided “as is” and “as available”. You agree not to hold us responsible for things other users post or do. You also agree not to hold us responsible for the payment processing of other service providers such as PayPal (each a “Third Party Payment Processor”. For greater certainty, as applicable, if you link a Third Party Payment Processor account to your Eco-Locals Account, you acknowledge and agree that by making payments through Eco-Locals with that Third Party Payment Processor, you are bound by that Third Party Payment Processor’s applicable terms and conditions, and we are not liable for any loss, claims or damages howsoever arising in connection with that third party’s services). As most of the stuff on the Eco-Locals Services comes from other users, we do not guarantee the accuracy, completeness, efficacy or timeliness of any postings or user communications or the quality, safety, or legality of what is offered. We also cannot guarantee continuous or secure access to our Services. Notification functionality in our Services may not occur in real time. Such functionality is subject to delays beyond our control, including without limitation, delays or latency due to your physical location or your wireless data service provider’s network. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Eco-Locals, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

 

Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.

Indemnification. You will indemnify and hold harmless Eco-Locals and its affiliates and our and their respective officers, directors, agents and employees (each an “Indemnified Party”), from any claim made by any third party, together with any amounts payable to the third party whether in settlement or as may otherwise be awarded, and reasonable legal costs incurred by any of the Indemnified Parties, arising from or relating to your use of the Eco-Locals Services, any alleged violation by you of the applicable terms, and any alleged violation by you of any applicable law or regulation. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, but doing so will not excuse your indemnity obligations.
Personal Information. By using Eco-Locals Services, you agree to the collection, transfer, storage and use of your personal information by Eco-Locals. (the “data controller”) on servers located in the United States and in the European Union as further described in our privacy policy.

 

General. These terms and the other policies posted on Eco-Locals Services constitute the entire agreement between us and you, superseding any prior agreements. This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. We both submit to the jurisdiction of the courts of the Province of Ontario. This will not affect your statutory rights if you are a consumer and applicable consumer law requires application of another law for certain topics. If we don’t enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below (our assignment to an affiliate will not require notice). Re: User Inquiries

We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing. We may update this agreement at any time, with updates taking effect when you next use the site or after 30 days, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us. Send questions, comments or complaints to Eco-Locals Customer Support.

Mobile Devices Terms
If you’re accessing Eco-Locals Services from a mobile device using a Eco-Locals Mobile Application (the “Application”), the following terms and conditions (“Terms of Use”) apply to you in addition to the applicable Mobile Privacy and Legal Notice or End User License Agreement, as the case may be.Your use of the Application confirms your agreement to these Terms of Use.

Application Use. Eco-Locals grants you the right to use the Application only for your personal use. You must comply with all applicable laws and third party terms of agreement when using the Application (e.g. your wireless data service agreement). The Application may not contain the same functionality available on the www.Eco-Locals.com website. Your download and use of the Application is at your own discretion and risk, and you are solely responsible for any damages to your hardware device(s) or loss of data that results from the download or use of the Application.

Intellectual Property – Applications. Eco-Locals owns, or is the licensee to, all right, title, and interest in and to its Applications, including all rights under patent, copyright, trade secret, trademark, and any and all other proprietary rights, including all applications, renewals, extensions, and restorations thereof. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from any Application and you will not remove, obscure, or alter Eco-Locals’s copyright notice, trademarks or other proprietary rights notices affixed to, contained within, or accessed in conjunction with or by any Eco-Locals Application.

Prohibited Countries Policy and Foreign Trade Regulation – Applications. Eco-Locals Applications or their underlying technology may not be downloaded to or exported or re-exported: (a) into (or to a resident or national of) Burma (Myanmar), Cuba, Iraq, Iran, Libya, North Korea, Sudan, Syria, or any other country subject to United States embargo; (b) to anyone on the US Treasury Department’s list of Specially Designated Nationals or on the US Commerce Department’s Denied Party or Entity List; and (c) to any prohibited country, person, end-user, or entity specified by US Export Laws. When using an Eco-Locals Application, you are responsible for complying with trade regulations and both foreign and domestic laws (e.g., you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a “terrorist supporting” country, and you are not listed on any US Government list of prohibited or restricted parties).

Additional Terms. Additional terms and conditions that apply to you based on the mobile device the Application is installed on:

iOS – Apple

  1. These Terms of Use are an agreement between you and Eco-Locals, and not with Apple. Apple is not responsible for the Application and the content thereof.
  2. Eco-Locals grants you the right to use the Application only on an iOS product that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.
  3. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
  4. Apple is not responsible for the investigation, defense, settlement, and discharge of any third party intellectual property infringement claim.
  5. Apple is not responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (a) product liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
  6. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if applicable, for the Application to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
  7. Apple and Apple’s subsidiaries are third party beneficiaries of these Terms of Use, and, upon your acceptance, Apple as a third party beneficiary thereof will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you.

Windows – Microsoft

  1. These Terms of Use are an agreement between you and Eco-Locals, not Microsoft. The terms of use and privacy policies of Microsoft and, where applicable, the network operators that provide billing services for the Windows Phone Marketplace do not apply to your use of the Application.
  2. You may install and use one (1) copy of the Application on up to five (5) devices you personally own or control and which are affiliated with the Windows Live ID associated with your Windows Marketplace account. You may not install or use a copy of the Application on a device you do not own or control.
  3. Microsoft, your device manufacturer, and (if applicable) your wireless carrier are not responsible for providing support services for the Application.
  4. Microsoft, the wireless carriers over whose network the Application is distributed (if applicable), and each of their respective affiliates and suppliers (collectively, “Disclaiming Distributors”) give no express warranty, guarantee, or conditions under or in relation to the Application. To the extent permitted under your local laws, the Disclaiming Distributors exclude any implied warranties or conditions, including those of merchantability, fitness for a particular purpose, and non-infringement.
  5. You, and not the Disclaiming Distributors, bear the risk of using the Application (even if the Disclaiming Distributors have been advised of the possibility of damages to you). You may have additional consumer rights under your local laws which these Terms of Use cannot change.
  6. To the extent not prohibited by law, you will not seek to recover any consequential, lost profit, special, indirect, or incidental damages from any Disclaiming Distributor.

Scope

This privacy notice applies to any Eco-Locals.com website, application, service, or tool (collectively “Services”) where this privacy notice is referenced, regardless of how you access or use them, including through mobile devices.

This privacy notice also applies to the provision of Eco-Locals.com services through any Eco-Locals.com partner’s website, application, service, or tool where it is referenced and where your listings and their content are published or advertised in accordance with the terms of this privacy notice.

We may amend this privacy notice at any time by posting the amended version on this site including the effective date of the amended version. We will announce any material changes to this privacy notice through via email.

Personal information we collect

We collect personal information from you and any devices (including mobile devices) you use when you: use our Services, register for an account with us, provide us information on a web form, update or add information to your account, participate in a community board discussion chat, or when you otherwise correspond with us.

Some of this personal information, such as a way to identify you, is necessary to enter into our User Agreement. The provision of all other personal information is voluntary, but may be necessary in order to use our Services, such as the bidding, buying or selling information needed to conclude a transaction.

We may also collect personal information from other sources, as described below.

Personal information you give us when you use our Services or register for an account with us

  • Identifying information such as your name, addresses, telephone numbers or email addresses when you register for an account with us.
  • Bidding, buying, or selling information you provide during a transaction, or other transaction-based content that you generate or that is connected to your account as a result of a transaction you are involved in.
  • Other content that you generate, or that is connected to your account (such as adding items to your basket, adding items to your Watch List, creating collections, and following other collections and sellers).
  • Financial information (such as credit card or bank account numbers) in connection with a transaction.
  • Postage, billing and other information used to purchase or send an item, as well as, where postal services are provided through one of our programs, information required to clear customs (such as Tax ID or other identification numbers) and relevant postage information (such as tracking numbers and tracking updates).
  • In some instances, when you use our Services, you may provide age, gender, interests and favorites.
  • You may also provide us other information through a web form, by updating or adding information to your account, through your participation in community discussions, member-to-member communications, chats, dispute resolution, or when you otherwise communicate with us regarding our Services.
  • Additional information we are required or authorized by applicable national laws to collect and process in order to authenticate or identify you or to verify the information we have collected.

Personal information we collect automatically when you use our Services or register for an account with us

  • We collect information about your interaction with our Services, your advertising preferences, and your communications with us. This is information we receive from devices (including mobile devices) you use when you access our Services. This information could include the following: Device ID or unique identifier, device type, ID for advertising, and unique device token.
  • Location information, including location information from your mobile device. Keep in mind that most mobile devices allow you to control or disable the use of location services by any application on your mobile device in the device’s settings menu.
  • Computer and connection information such as statistics on your page views, traffic to and from the sites, referral URL, ad data, your IP address, your browsing history, and your web log information.

Personal information we collect using cookies and similar technologies

  • We use cookies, web beacons, unique identifiers, and similar technologies to collect information about the pages you view, the links you click, and other actions you take when using our Services, within our advertising or email content.

Personal information collected from other sources

  • We supplement the personal information we collect directly with information collected from third parties and add it to your account information. For example, we collect and use demographic and other information that is publically available in an applicable jurisdiction, additional contact information, credit check information, and information from credit bureaus, as allowed by applicable national laws
  • Social Media. We allow you to share information with social media sites, or use social media sites to create your account or to connect your account with the respective social media site. Those social media sites may give us automatic access to certain personal information retained by them about you (e.g., content viewed by you, content liked by you, and information about the advertisements you have been shown or have clicked on, etc.). If you provide us with access to any site with video content, then you agree that we can share your video viewing with, or obtain information about your video viewing from, third-party social media sites for at least two years or until you withdraw authorization or connection to the social media site. You control the personal information you allow us to have access to through the privacy settings on the applicable social media site and the permissions you give us when you grant us access to the personal information retained by the respective social media site about you. By associating an account managed by a social media site with your account and authorizing us to have access to this information, you agree that we can collect, use and retain the information provided by these social media sites in accordance with this privacy notice. We may also use plug-ins or other technologies from various social media sites. If you click on a link provided via a social media plug in, you are voluntarily establishing a connection with that respective social media site.
  • If you give us personal information about someone else, you must do so only with that person’s authorization. You should inform them how we collect, use, disclose, and retain their personal information according to our privacy notice.
How we use your personal information

We use the personal information we collect from you for a range of different business purposes and according to different legal bases of processing. The following is a summary of how and according to which legal bases we use your personal information.

We use your personal information to fulfill a contract with you and provide you with our Services, to comply with our legal obligation, protect your vital interest, or as may be required for the public good. This includes:

  • To provide payment processing and account management, operate, measure and improve our Services, keep our Services safe, secure and operational, and customize site content that includes items and services that you may like in response to actions that you take.
  • To contact you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed or as otherwise necessary to provide you customer service.
    • When contacting you for such purposes as outlined above, we may contact you via email, telephone, SMS/text messages, postal mail, and via mobile push notifications.
    • When contacting you via telephone, to ensure efficiency, we may use autodialed or pre-recorded calls and text messages as described in our User Agreement and as authorized by applicable law. Message and data rates may apply.
  • To provide other services requested by you as described when we collect the information.
  • We use general location information to provide you with location based services (such as advertising, search results, and other personalized content).
  • To prevent, detect, mitigate, and investigate fraud, security breaches or other potentially prohibited or illegal activities.
  • To enforce Eco-Locals.com User Agreement, this privacy notice, or other policies, and to monitor restrictions on offers to buy or sell outside of Eco-Locals.com and member-to-member communications for violations of our policies or applicable laws.

We use your personal information to pursue our legitimate interests where your rights and freedoms do not outweigh these interests.  We have implemented controls to balance our interests with your rights.  This includes to:

  • Improve our Services, for example by reviewing information associated with stalled or crashed pages experienced by users allowing us to identify and fix problems and give you a better experience.
  • Personalize, measure, and improve our advertising based on your advertising customization preferences.
  • Contact you via email or postal mail in order to offer you coupons, discounts and special promotions, poll your opinions through surveys or questionnaires and inform you about our Services, as authorized by applicable law.
  • Contact you about public policy matters, or other current events, related to your ability to use our Services. This could include an invitation to join a petition, letter writing, call or other sort of public policy related campaigns.
  • Deliver targeted marketing, service updates, and promotional offers based on your communication preferences.
  • Measure the performance of our email marketing campaigns (e.g. by analyzing open and click rates).
  • Measure sellers’ performance (e.g. by using shipment tracking information that sellers and shipping providers send or provide through Eco-Locals.com).
  • Monitor and improve the information security of our site and mobile applications.

With your consent, we may use your personal information to:

  • Provide you with marketing via telephone calls, SMS or text.
  • Provide you with marketing from other eco-locals.com corporate family members.
  • Provide you with marketing from third parties.
  • Customize third party advertising you might see on third party websites.
  • Use your precise geo-location to provide location based services.
  • Use your sensitive personal information to facilitate transactions in certain categories.

You have the right to withdraw your consent at any time.

We may use technologies considered automated decision making or profiling. We will not make automated-decisions about you that would significantly affect you, unless such a decision is necessary as part of a contract we have with you, we have your consent, or we are required by law to use such technology.

Your choices about how we use your personal information

Communication preferences

You can control your email communication preferences in you profile. Through buddypress and 3rd party wordpress plugins, you can also control your member-to-member communications preferences setting and choose which newsletters and promotions you want to receive.

Marketing

If you do not wish to receive marketing communications from us, you can unsubscribe via the link in an email you received, change your Communication Preferences within your profile, indicate your communication preferences using the method described within the direct communication from us or contact us as described in the Contact Us section. If we transfer personal information along with the content of your listings to third party providers, this will be solely on the basis of an agreement limiting use by the third party provider of such personal information to processing necessary to fulfil their contract with us and obligating the third party provider to take security measures with regard to such data. Third party providers are not permitted to sell, lease or in any other way transfer the personal information included in your listings to third parties.

Law enforcement, legal proceedings, and as authorized by law

  • To comply with our legal requirements, enforce our User Agreement, respond to claims that a listing or other content violates the rights of others, or protect anyone’s rights, property or safety.
  • To law enforcement or governmental agencies, or authorized third-parties, in response to a verified request or legal process relating to a criminal investigation or alleged or suspected illegal activity or any other activity that exposes us, you, or any other of our users to legal liability. We will only disclose information we deem relevant to the investigation or inquiry, such as name, city, state, postcode, telephone number, email address, User ID history, IP address, fraud complaints, bidding and listing history.
  • To participants of Eco-Locals.com programs globally under confidentiality agreement, as we in our sole discretion deem necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, we will disclose seller’s name, street address, city, state, postcode, country, phone number, email address and company name to the participants of any Eco-Locals.com programs.
  • To credit agencies or bureaus as authorized by applicable national laws (e.g. information on late or missed payments or other defaults on your account that may be reflected in your credit report or file).
  • To third parties involved in a legal proceeding, if they provide us with a subpoena, court order or substantially similar legal basis, or we otherwise believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

Other Eco-Locals.com users as authorized by you or your use of our Services

  • When transacting with another user, the other user may request that we provide him/her with information about you necessary to complete the transaction, such as your name, account ID, email address, contact details, shipping and billing address, or other information from you needed to promote the reliability and security of the transaction.
  • If a transaction fails, is put on hold, or is later invalidated, we may also provide the other user with details of the unsuccessful transaction
  • The other user receiving your information should only use it for purposes related to the transaction. Unless you have consented to receive marketing from them, they should not contact you for marketing purposes.
  • Contacting users with unwanted or threatening messages is a violation of our User Agreement.

We may disclose your personal information to PayPal Inc. and its corporate family

  • To prevent, detect, mitigate, and investigate potentially illegal acts, fraud and/or security breaches, and to assess and manage risk, including to alert you if fraudulent activities have been detected on your Eco-Locals.com or PayPal accounts
  • To provide customer services, including to help service your account or resolve disputes (e.g., billing or transactional disputes)
  • To facilitate the processing of payment cards when you pay within our Services with a payment card and we use PayPal to process your payment
  • To facilitate shipping and related services for purchases you made using PayPal

Change of Ownership

If we are subject to a merger or acquisition with/by another company, we may share information with them in accordance with our global privacy standards. Should such an event occur, we will require that the new combined entity follow this privacy notice with respect to your personal information. When you share your personal information on our sites or applications – what happens?

Other users have access to the information you share on Eco-Locals.com. For example, other users can see your bids, purchases, items for sale, your collections, the sellers and collections you follow, storefronts, feedback, ratings, product reviews and associated comments. Other users can also see any information you chose to share in your profile or your collections.

When you use our Services, your public user ID may be displayed and available to the public and associated with all of your public Eco-Locals.com activity. To help protect your privacy, we allow only limited access to other users’ contact, shipping and financial information as necessary to facilitate your transactions and collect payments. However, when users are involved in a transaction, they have access to each other’s name, user ID, email address and other contact and shipping information.

When you transact with another user, we enable you to obtain or we may provide you with the personal information of the other user (such as their name, account ID, email address, contact details, shipping and billing address) to complete the transaction. Independent from us, you are the controller of such data and we encourage you to inform the other user about your privacy practices and respect their privacy. Unwanted or threatening email

We do not tolerate abuse of our Services. You do not have permission to add other users to your mailing list (email or postal), call, or send him/her text messages for commercial purposes, even if this user purchased something from you, unless the user has given his/her explicit consent. Taxes

GST/HST/QST ON ECO-LOCALS AD FEATURES
Our services are provided by Eco-Locals., which is required to collect any applicable taxes on services provided in accordance with Canadian tax laws. For instance, if you purchase Ad Features (i.e. Bump Up, Top Ad, etc.) or post ads in paid categories, we will collect GST/HST/QST based on your province of residence. This is not a price increase – we are simply collecting and passing on to the government applicable taxes on our services.
Any taxes collected on Eco-Locals services will be listed as a separate charge on your seller invoice and/or at checkout for purchases of ‘add promotion features.’
If you are a business user, check with your financial advisor to see if your company might be eligible for an Input Tax Credit for sales tax collected on Eco-Locals services.

Ad Reply Code of Conduct

 

While Eco-Locals does not actively monitor replies sent within our system between users, we reserve the right to delete or ban those who we deem to be using replies inappropriately.

 

When contacting other users:

  • Please treat them with courtesy and respect.
  • Please do not reply to ads with unsolicited opinions, comments, or judgements on the content of the ads or about the poster.
  • All replies to ads must be in connection to what the ad is offering. Replies regarding other commercial offers are not permitted.
  • Abusive ad replies are not permitted. Any replies containing hate speech or defamation are strictly prohibited.
  • Impersonating other users, including supplying fake phone numbers is not permitted, and those who are found to be doing so may lose the ability to use Eco-Locals.

Eco-Locals reserves the right to revoke the ability of any users to reply to ads without notice.

Age Restriction

Eco-Locals cares about the safety of your entire family. We understand that in the age of technology, kids are on the internet more than ever and free online classifieds can be a fun way for them to find toys, video games, clothes, and other cool items.

While we pride ourselves on being a site that the whole family can use, we also know the concerns involved with transacting online.

We want to minimize these risks. Therefore, for anyone under 16 years of age, we ask that you have your parent/guardian respond to any ads you may be interested in. Also, if you wish to post an ad on Eco-Locals, have your parent/guardian do so on your behalf, so they can be directly involved in the transaction.

 

Eco-Locals reserves the right to remove any ad if we feel it is in the best interest and for the safety of our users.

 

Minimum Requirements

 

All  advertisements must include following information and adhere to the minimum requirements.

  1. LIST SOURCES-Show a map or list locations of where all materials are derived and refined/manufactured. Include all components of the product including any additives or other products required for developing the product, excluding machinery or other permanent physical infrastructure.
  2. STEWARDSHIP/EFFICIENCY-Demonstrate how your product uses less resources than conventional alternative and practices environmental stewardships. At a minimum, demonstrate fewer miles traveled, more upcycled/regional content, or less resource intensive processes than conventional alternatives. Products are heavily encouraged to use an environmental product declaration or land stewardship assessment conducted by a third party to demonstrate claims. All data used must be clearly presented and made publically available.

RE-USED: Products must be >50% recycled (pre or post-consumer content) , >50% reused, or a combination thereof.

LOCAL: Products must be >50% comprised of materials retained (harvested, extracted, processed, manufactured, reused, or recycled as applicable) from within 1,000 km of the final manufacturing location (by item cost).

ETHICAL: Companies should demonstrate that any resources used are farmed and procured ethically (e.g. local in-season produce, Forest Stewardship Council, Fair-Trade Alliance, Etc.).

  1. RESTRICTIONS: Products and packaging must not contain any of the below, unless they are naturally occurring in trace amounts:

Definitions

All claims made must be supported by transparent, clear, and publically available data.

Manufacturers are strongly urged to provide environmental product declarations to identify GHGs, water consumption, energy consumption and other impacts of product development.

% Recycled content refers to either pre-consumer or post-consumer recycled content of a finished product, as measured by weight or cost.

% Upcycled or reused content refers to materials which have been diverted from landfill after serving a useful life. These materials are re-used without being reprocessed through the processes that generated them. Calculated by weight or cost.

Waste Diversion Rate must be determined through a third-party waste audit which accounts for the actual diversion rate of waste over a minimum one year period. Audits must occur and be made available every 2 years. Auditors must:

-Use data provided by waste haulers. Data provided by haulers must be based on the actual weight or volume of materials diverted from landfill (e.g. co-mingled waste hauler data of verified diversion rates..)

OR

-Develop processes to make physical measurements to determine waste diversion rates before waste bins are collected by haulers. Teams must verify that loads are uncontaminated before being sent to the hauler.

Waste diversion rates may be calculated by weight or volume but must be consistent when calculating a diversion rate.

% Regional Content refers to the percentage of items which are completely extracted, manufactured and processed within 1,000 km radius of the final point of manufacturing. Calculated by weight or cost.

% Renewable Energy is calculated based on actual data from one year of operations and must include all energy associated with harvesting and manufacturing the product. Passive energy (e.g. sunlight, windmills, etc.) are not included. Data must not be more than 2 years old. Certified renewable energy credits contribute to the calculation but are de-rated by 50%.

kWh/kg (materials) is the sum of all non-passive energy used to extract, manufacture and process a product. This includes energy-use for supplemental materials (excluding permanent infrastructure) used to manufacture the product

Energy Owned By Final Manufacturer or Producer Energy use must be based on actual energy consumption and operations (e.g. utility bills, gas receipts). If energy must be re-allocated (e.g. a farmer uses a diesel tractor to till land for both corn and strawberries) any assumptions must be reasonable and transparently identified in documented literature (e.g. if 50% of the land was for corn and 50% was for strawberries the diesel use should be split equally). Separately metering energy use may be required for more complex processes.

Services Code of Conduct

 

When advertising services on Eco-Locals, please keep the following in mind;

 

All services advertised in classified ads and in reply to other ads must adhere to our services rules, as well as our regular posting policies. The following types of services are prohibited from being advertised on the site;

  • Adult, erotic or sexual services of any kind including but not limited to; bachelor parties, adult cleaning/ lawn care, webcamming, modeling, photography, escort and prostitution.
  • Massage service ads posted by anyone who is not a Registered Massage Therapist (RMT) and who is unable to provide insurance receipts for customers.
  • Massage service ads with full body photographs (photographs are to be limited to head shots or photographs of the facility).
  • Surrogate/ adoption/ donor services.
  • Model or photography service ads which do not offer a professional website or portfolio.
  • Financial lending service ads which do not offer company information such as business name, address and phone number. For more information, click here.

 

In addition, please keep in mind that;

  • Users offering a variety of Skilled Trade services must make every effort to bundle all related or overly similar services together in one ad. If each service is very distinctive – such as carpentry versus plumbing – then individual ads are certainly acceptable.
  • Replies to services ads for personal reasons or for solicitation of any sexual or otherwise inappropriate purposes are strictly prohibited and may result in a loss of ability to utilize Eco-Locals.

Tobacco and Related Items

Due to strict government regulations, we have a policy against the posting of any tobacco products such as loose leaf tobacco, cigarettes and cigars. After careful consideration, and at the request of our user community to keep the site child-friendly, we have also adopted policies against the following;

 

  • Hookahs
  • Bongs
  • Vaporizers
  • Shisha Molasses that includes tobacco
  • Nicotine inhalers or nasal sprays
  • Ads that include photos of any of the above items even if the Ad is for something else
  • Tobacco products packaged in classic packaging

We also do not allow the sale of E-cigarettes. Health Canada has deemed them potentially dangerous as they are unregulated in Canada. This applies to both nicotine and non-nicotine containing brands.

Eco-Locals.com is providing this carpool matching and courier service free of charge. Any agreement made between You and fellow carpoolers regarding cost sharing does not involve Eco-Locals.com.

You consent to Eco-Locals.com’s collection, use and disclosure of Your email address and full name. Your full name and email address will not be disclosed to the general membership. YOU MAY ACCESS, CORRECT AND DELETE YOUR OWN PERSONAL INFORMATION STORED BY ECO-LOCALS.COM BY USING THE WEBSITE OR BY EMAILING THE ADMINISTRATOR THROUGH THE “CONTACT US” PAGE.

Insurance Coverage

As a carpool or courier driver, it is solely your responsibility to notify your insurance provider of your intent to carry passengers and insure that you have adequate insurance coverage to protect yourself and your passengers. A minimum of $2,000,000 third party liability coverage and underinsured motorist protection are recommended and cost only a few extra dollars each year. As a carpool passenger, it is your responsibility to insure that your driver is adequately insured as described above.

 

Greenhouse Gas and Other Off-sets

By registering with Eco-Locals.com you and your organization agree to convey ownership to Eco-Locals.com of all reductions in greenhouse gas emissions resulting from the use of our service. The ownership of these reductions may be conveyed by Eco-Locals.com, at its sole discretion, to assist in securing funding to support the delivery of the Eco-Locals.com services across Canada and other countries.
